  • Partner Drivers: those who provide transportation service to Users, individually through their OkayVAN account or through partner transportation companies.

  • Transportation Request Recipients: Those who request transportation and services via pickup and drop-off using an OkayVAN account and application.

  • Delivery partner: those who provide transport services via OkayVAN.

This policy also governs other data collection activities related to OkayVAN's services. For example, we may collect contact information from business owners or employees, contact information from those who manage and use accounts owned by Business Customers, or information from those who begin but do not complete the process of becoming a driver partner or handler. to transportation.
All individuals subject to this policy are referred to herein as "users".
Our privacy practices are subject to the laws in the countries in which we operate. This means that we engage in the practices described in this policy in a specific country or region only if permitted under local law.

1. Data provided by users. These include:

  • Account Information: We collect data when users create or update their OkayVAN accounts or make transportation requests. This includes your first and last name, email address, phone number, username and password, address, profile photo.
    For partner drivers and transport personnel, information on bank details to perform direct and automatic transfers, on vehicles or insurance, certificates based on the selected service, eligibility for the provision of services via the OkayVAN app is also included.

  • Documents and photos for identity verification: This includes government-issued identification documents, such as driver's licenses or passports (which may contain photo and identification numbers, date of birth, and gender), and user-submitted photos such as selfies and photos of the profile.

  • Demographic Data: We collect demographic data such as date of birth/age, gender or occupation as necessary to enable certain features or provide access to age-restricted products or services. For example, we collect users' date of birth or age to verify eligibility to use the OkayVAN platform.

2. Data created when using our services. These include:

  • Location information (partner driver and partner drivers): We collect precise and approximate location information from the mobile devices of partner drivers and people involved in transport or various services example of assembly or installation when the OkayVAN app is running in the foreground (app open and on the screen) or in the background (app open but not on the screen).

  • Location information (users and order recipients). We collect precise and/or approximate location information from users' and order recipients' mobile devices if they allow us to do so through their device settings.

    Users and order recipients can use OkayVAN apps without allowing location information to be collected from their mobile devices. However, this may affect some features of the OkayVAN apps. For example, a user who has not authorized precise location information will not be able to execute and send transportation requests to multiple drivers nearby.
    Additionally, precise location information collected from your driver-partner's device during a ride is linked to your account, even if you have not enabled the collection of precise location information from your device. This data is used for purposes such as customer service, fraud detection, insurance, litigation, and receipt generation.

  • Transaction Information: We collect transaction information about your use of our services, such as the type of service requested or provided; the details of the trip or order (such as date and time, recipient telephone number for receiving the OTP code via SMS to validate the transaction and conclude the service, required collection and delivery addresses if necessary, distance traveled and gender/details on what to carry); and payment transaction information (such as your name and location, amount charged, and payment method).

  • Usage Data: We collect data about how users interact with our services. This includes access dates and times, app features or pages viewed, browser type, app crashes, and other system activity.

  • Device Data: We collect data about the devices you use to access our Services, including hardware models, IP address or other unique device identifiers, operating systems and versions, software, preferred languages, device movement data, and mobile network data .

3. Data from other sources. Among which:

  • users who participate in our invitation programs. For example, when a user invites another person, we receive the data of the invited individual.

  • OkayVAN account owners who request services on behalf of other users (such as friends or family) or who allow other users to request or enjoy services through their business account (such as Business Customers).

  • information provided by users or others in connection with complaints or disputes.

OkayVAN uses the data collected:

  • enable transportation, delivery and other services or features, such as:
    - using location information to locate users' departure points and delivery points, calculate estimated arrival time, and monitor transportation status.
    - the activation of features that involve data sharing, such as sharing the name of the partner driver and vehicle information with users to facilitate departures or features that allow sharing the estimated arrival time.

6. Marketing and advertising.

For example, we may send push notifications suggesting favorite destinations or merchants, or in-app messages offering promotions for services or merchants similar to those a user has previously chosen.

  • display OkayVAN advertising on third-party apps or websites.

  • display third-party advertising in OkayVAN apps or in connection with our services. Additionally, we display ads for third-party products that are not available on OkayVAN apps.

    We also measure the effectiveness of OkayVAN and third-party ads displayed in OkayVAN apps or in connection with our services.

    OkayVAN carries out the aforementioned activities because they are necessary for its legitimate interests to inform users about the services and features of OkayVAN or its partners. 7. Communications not for marketing purposes.

We may use the data to send surveys and other communications that are not for the purpose of marketing OkayVAN or our partners' services or products.

8. Legal procedures and requirements.

We use the data to analyze or resolve complaints or disputes regarding the use of OkayVAN services, to comply with the requirements of applicable laws, regulations, licenses or operating agreements, insurance policies or based on legal proceedings or governmental requests, including by of law enforcement and judicial authorities.

C. Third party cookies and technologies

OkayVAN and its partners use cookies and other identification technologies on their apps, websites, emails and online advertising for the purposes described in this policy and in the Cookie Policy.

Cookies are small text files stored on your browser or device by websites, apps. OkayVAN uses cookies and similar technologies for purposes such as:

  • authenticate users

D. Data sharing and disclosure

OkayVAN can share data:

1. With other users

For example for sharing:

  • User's name, rating and departure and/or arrival points with partner drivers.

  • For driver partners and delivery partners, we may share data with you, including your name and photo; make, model, color and license plate of the vehicle, location (before and during the ride); average user rating; total number of trips; length of time since they registered as partner drivers or partner drivers; contact info; profile of the partner driver or partner driver, including compliments and other feedback submitted by previous users.

  • With an account holder, in cases where the account is used by another person, for example when a user uses their employer's OkayVAN for Business profile, a user or the recipient of the order uses an account linked to their family profile, a partner driver or transport person uses an account owned by or associated with a partner transport company, or an OkayVAN partner driver or transport person acts as a substitute (UK only) .
    Additionally, if you create an account using an email address affiliated with an OkayVAN for Business account owner (for example, your employer), we may use and share your profile information (such as your name and email address) with that account owner, to help you charge rides or orders to that OkayVAN for Business account.*

2. At the request of users or with the consent of users

For example for sharing data with:

  • OkayVAN business partners. For example, if a user requests a service through a third-party partnership or promotional offer, OkayVAN may share some data with them. Such third parties may include, for example, other services, platforms, apps or websites that integrate with our APIs; suppliers of vehicles or related services; third parties with an API or service with which we integrate and their users in connection with promotions, contests or specialized services.

4. For legal reasons or in case of dispute

We may share your data if we believe it is necessary to do so pursuant to applicable laws, regulations, licenses or operating agreements, legal process or administrative requests, applicable insurance policies, or where disclosure is otherwise necessary for security or other similar reasons. .
This includes sharing data with law enforcement agencies, judicial authorities, public health authorities, other public authorities, airports (if requested by airport authorities as a necessary condition for operating within them), insurance companies or other third parties to the extent necessary to enforce the Terms of Use, user agreements or other policies; to protect the rights or property of OkayVAN or the rights, safety and property of others; or in the event of complaints or disputes relating to the use of our services. If there is a dispute over the use of another person's credit card, we may be required by law to share your information with the credit card holder, including ride information and requested transportation.

We may share your information in ways other than as described in this policy if we notify you and you agree to the sharing.

E. Data storage and deletion

OkayVAN retains user data for as long as necessary for the purposes described above. Users can request account deletion via OkayVAN apps and websites.

OkayVAN retains user data for the period of time necessary for the purposes described above, which varies depending on the type of data, the category of users to which it refers, the purposes for which it was collected and the need to retain the data after a request to delete your account for the purposes described below.

For example, we store data:

  • for as long as user accounts are active, if such data is necessary to provide our services. E.g., account data.

  • for 3 years, if necessary to comply with tax requirements. For example, information about the pick-up and drop-off location or the route of partner drivers and partner drivers.

  • for defined periods, if necessary for security or fraud prevention purposes. For example, we keep incomplete driver partner requests for 1 year and rejected driver partner requests for 3 years.

Users can request deletion of their account via the OkayVAN app or via the OkayVAN website at the following email address support@okayva.com.

Following account deletion requests, we will delete your account and data, except as necessary for safety, security, fraud prevention, or compliance with legal requirements, or due to issues relating to your account (e.g. an unresolved complaint or dispute). For driver partners and transportation personnel, this generally means that we retain some of their data for as long as necessary for actual or potential tax claims, litigation, or insurance claims. We generally delete order user data within 120 days of requesting account deletion.

4. Choice and transparency

OkayVAN allows users to access and/or control the data it collects, including by:

  • privacy settings

  • device permissions

  • in-app evaluation pages

  • marketing and advertising choices

In addition, OkayVAN allows users to request access to their data or copies thereof, make changes or updates to their account, request account deletion, or request that OkayVAN limit the processing of user data.

  • Real-time location sharing (users and order recipients)
    Users and order recipients can enable/disable OkayVAN sharing real-time location data from their mobile device with partner drivers or delivery persons (as applicable) via their device settings, at which can be accessed from the Account > Settings > Privacy > Location Sharing menu on the OkayVAN app and from the Account > Privacy > Location Sharing menu on the OkayVAN app.

  • Notifications: Account and ride updates
    OkayVAN sends users ride status notifications and updates associated with account activity. These notifications are an integral part of using the OkayVAN app and cannot be turned off.

  • Notifications: discounts and news
    Users can allow OkayVAN to send push notifications regarding OkayVAN discounts and news. Users can decide whether to receive push notifications here or via the OkayVAN Privacy Center.

2. Device permissions

Nearly all mobile platforms (iOS, Android, etc.) have defined specific types of device data that apps cannot access without permission from the device owner, and use different methods to obtain that permission. Users should check the settings available on their devices or contact their provider.

3. In-app evaluation pages

After each ride, users can perform a rating using a scale of 1 to 5. An average of these ratings is associated with a driver's account and is shown to other users who receive an offer from a partner driver or partner drivers .

4. User requests regarding data

  • Changing or updating information: Users can change their name, email address, phone number, address and profile photo via the (My Profile) menu next to their profile photo in the OkayVAN apps.

  • Deletion of Data: Users can request deletion of their account via the OkayVAN app or via the OkayVAN website at the following email address support@okayva.com.

5. Legal notices

A. Data Controllers and Data Protection Officer

OkayVAN is the data controller of data processed in connection with your use of OkayVAN services globally, except where it is a joint controller with other OkayVAN affiliates.
